Designing and securing partnerships in a legally secure manner

Entering into a civil partnership or a long-term partnership is probably one of the most significant decisions in each of us’ lives.

The law primarily offers marriage as a form of arrangement for this, which not only represents a sign of mutual commitment, but also triggers a variety of legal consequences and effects and brings with it changes.

All those who do not, or are not yet, willing to take the step of marriage will organize their relationship as a so-called non-marital partnership. The increasing number of such legally unregulated partnerships raises a multitude of questions.

For each of the possible options for shaping a shared life path, there are various aspects to consider, such as:

  • What happens to the sole assets of one of the partners in the event of a separation, and what about any joint assets?
  • Does it make sense to acquire assets (such as a house or apartment) jointly or only through one partner alone?
  • Does this decision have any tax consequences?
  • Does one of the partners have to be liable for any debts of their partner?
  • How can adequate security for old age be achieved, for example, if one partner gives up their job to care for children?
  • Does one of the partners have any claims against the other in the event of illness or incapacity to work?
  • What rights and obligations exist with regard to the children they share?
  • What happens in the event of a separation?
  • What happens if one of the partners dies?

The answers to these questions are often highly varied.

The outcome depends on the circumstances of the individual case, but also on whether the parties are married or living together as a non-marital partner. In all of these cases, however, it is possible to regulate the legal consequences of the relationship and a possible separation through individual agreements.

A fundamental prerequisite for any agreement, however, is a thorough knowledge of the legal and statutory situation. As impartial advisors, we notaries are able to provide this information and offer a balanced and reasonable contractual arrangement. We will work with you to develop a customized solution for the questions and issues that arise in your specific case.

Another important area of notarial practice in family law is the relationship between parents and children, including any questions regarding adoption.

If a relationship has broken down, we can help you organize the separation and division of assets in a low-conflict and cost-effective manner. In particular, a notarized separation and divorce agreement offers the opportunity to settle many of the issues that need to be resolved contractually. This makes the divorce process more streamlined, faster, and significantly less expensive due to the reduced value in dispute.

We, as notaries, are the right contact for all aspects of family law. We are happy to assist you.
